Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the campuscaptions.com website (the "Website"). The Website is operated by Campus Captions ("Campus Captions," "we," "us," or "our").

By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

1. About the Website and the relationship it creates

The Website is an informational website. It describes the professional services offered by Campus Captions — including audio description, captioning, transcription, and video accessibility evaluation for educational and public institutions.

The Website does not, by itself, create a service relationship. Nothing on the Website is an offer to perform services, a quote, or a binding commitment. Campus Captions provides services only under a separate written agreement — a Statement of Work, and where applicable a Data Processing Addendum and related contract documents. If there is any conflict between the Website and a signed agreement, the signed agreement controls.

Using the Website, or contacting us through it, does not make you a client and does not create any professional, contractual, or confidential relationship.

2. Permitted use of the Website

You may view and use the Website for lawful informational purposes — to learn about our services and to contact us. You agree not to:

  • use the Website in violation of any applicable law or regulation;
  • attempt to gain unauthorized access to the Website, its servers, or any connected systems;
  • interfere with or disrupt the Website or its underlying infrastructure;
  • copy, scrape, or harvest content from the Website for resale or for competing commercial use; or
  • use the Website to transmit unlawful, infringing, or harmful material.

3. Intellectual property

The Website and its content — including text, page design, graphics, logos, and the Campus Captions name and brand — are owned by Campus Captions or used under license, and are protected by intellectual-property law. You are granted a limited, non-exclusive, revocable permission to view the Website for the informational purposes described in Section 2. No other rights are granted. You may not reproduce, republish, or create derivative works from Website content without our prior written permission, except that you may share ordinary links to the Website.

"Voluntary Product Accessibility Template" and "VPAT" are registered service marks of the Information Technology Industry Council (ITI) and are referenced for descriptive purposes only.

4. No professional or accessibility-compliance advice

Information on the Website is provided for general informational purposes. It is not legal advice, not compliance advice, and not a guarantee of any regulatory outcome. Accessibility obligations — including those under the Americans with Disabilities Act, Section 504, Section 508, and applicable Web Content Accessibility Guidelines — depend on facts specific to each institution and each piece of content. Statements on the Website about standards, regulations, or compliance deadlines are general descriptions and may change as law and guidance evolve. You should not act, or decline to act, based solely on Website content; obtain advice appropriate to your specific circumstances, including from legal counsel where appropriate.

Any description of conformance of Campus Captions deliverables with accessibility standards is set out in the applicable Accessibility Conformance Report (ACR) and in the governing service agreement, not on the Website.

5. How to submit work and engage services

The Website does not host an upload portal or an application for submitting content. If you wish to engage Campus Captions, contact us using the details in Section 11. Any exchange of source video or institutional content takes place only after a written agreement is in place, and only through the secure, access-controlled file-exchange arrangements established for that engagement. Do not send institutional content, student education records, or other regulated data through general Website correspondence.

6. Links to third-party websites

The Website may link to websites operated by others — for example, accessibility standards organizations or institutional partners. We provide these links for convenience and do not control, endorse, or take responsibility for third-party websites or their content. Your use of any third-party website is subject to that site's own terms and policies.

7. Disclaimer of warranties

The Website is provided "as is" and "as available." To the fullest extent permitted by law, Campus Captions disclaims all warranties of any kind regarding the Website, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, secure, or free of harmful components, or that information on the Website is complete, accurate, or current.

This Section applies to the Website only. Warranties, service levels, and commitments relating to Campus Captions services are addressed exclusively in the applicable written service agreement.

8. Limitation of liability

To the fullest extent permitted by law, Campus Captions and its principal, personnel, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or relating to your use of — or inability to use — the Website, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Website will not exceed one hundred U.S. dollars (USD $100).

This Section applies to the Website only and does not limit, expand, or otherwise affect any rights, remedies, or liability provisions set out in a signed service agreement, which govern the services themselves.

9. Indemnification

You agree to indemnify and hold harmless Campus Captions and its principal, personnel, and contractors from any claims, losses, or expenses (including reasonable legal fees) arising out of your misuse of the Website or your violation of these Terms.

10. Changes to the Website and to these Terms

We may modify, suspend, or discontinue any part of the Website at any time without notice. We may also update these Terms from time to time; the current version is always posted on this page with its effective date. Your continued use of the Website after a change takes effect constitutes acceptance of the updated Terms.

11. Contact

For questions about these Terms or about the Website, please contact us using the information on our main page.

12. Governing law and venue

These Terms, and any dispute arising out of or relating to these Terms or the Website, are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. You agree that the state and federal courts located in New York have exclusive jurisdiction over any such dispute, and you consent to venue in those courts.

13. Severability and entire agreement

If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full effect. These Terms are the entire agreement between you and Campus Captions regarding your use of the Website. Services provided by Campus Captions are governed by their own separate written agreements, which these Terms do not replace or modify.
